I do not have any more of those seeds at this time and I am waiting now for more of them at 2 per packet. Because I do beleive in treating a customer they way I would want to be treated, I am offering you a full refund. By offering a full refund on any item for any reason, I am certain that I am within the legal bounds of this "contract." Of course if you have that much time on your hands and feel you need to react over a $2.00 packet of seeds go ahead. A full refund is all I can do for you.

When a merchant advertises and a customer acts on that advertisement it is called a contract. According to the Commercial Code, contracts are “sacred” in our judicial system.



Neither one can legally unilaterally change the terms of the contract after it has been fulfilled: Offer, Consideration and Acceptance.

It appears that the difficulty you have is with the supplier. You should discuss your problem with them and explain the potential legal difficulty they are placing you in. You would probably have legal recourse against them. I assume they do “drop shipping “ for you!

So you say “He won’t take me to court over $2.

Don’t be misled about my options. I checked you out on garden watchdog; it had 3 Positives and no Negatives. This wasn’t a significant # of responses and I was concerned that you only use a P.O. Box. I took a chance on you (I ordered other Exotic seeds from another co.)

Last year I ordered a tree from SouthMeadow Gardens in Michigan. They never delivered and gave me the runaround. Then I found garden watchdog and saw how they had a highly negative report (above 75 %)

I contacted the Better Business Bureau the Attorney Generals Office in Michigan and the Postal authorities.




I’m not threatening. What I am trying to do is show you that you should NEVER mistreat a customer. Remember that the customer is always right, even when he is wrong. Ask yourself “how would Wal-mart handle a situation like this.”



As a matter of fact I know of an improvement that you could make to your web site.

Please send me the other 3 seeds before this spring
