What are the Rules about Propagating clematis?

I know with roses..they are patented for 20 years....is it the same with Clematis?

Propagating for yourself is one thing, and propagating for sale is another.... If its for your own use, do what you wish. If you're going to be selling it, you need to have your ducks in a row and I can't help you there.. Good luck.

I wonder if some growers try to get around the pattent by selling the plant under a generic name,

Last year at Walmart I bought 3 labeled "Pink Clematis" when they were in bloom, but slightly past their peak and half priced.

They sure looked a lot like Josephine to me, and a grower from New Zealand on Gardenbuddies agreed with me. This is picture of #3 in the parking lot.
