Chestnut?

This seedling found growing in corner of the garden under a fence. Horse Chestnut?
If so, is it deer resistant when a young tree?

looks like a type of oak to me, but I don't know for sure. Maybe someone else will.

One of the red oak group (Quercus sect. Lobatae). Impossible to tell which species at this age; the leaves on seedling oaks are different shape to the adult leaves.

Looks like the Shumard oaks that volunteer everywhere around here. Not saying it is a Shumard. Too young to tell for me. But I encourage you to keep it. Yes, I'd say it's definitely deer bait but I would do my best to protect it if it were mine.

An oak! That is somewhat exciting, actually. There are few oaks around me -- mainly maples, chestnuts and Norway Spruce. But there must be one, then, in squirreling distance. I am watching to see when it does anything other than grow taller.
