This is a paper wasp of the family Vespidae. These are the wasps that often build open nests in eaves of homes. Unlike the wasp above, these wasps can be aggressive if their nest is threatened, but in general, when they are out alone hunting, they won't sting unless threatened (i.e. swatted or hit at).
